1. Acceptance of Terms

By downloading, installing, or using the My Comuna mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and My Comuna regarding your use of the App and related services.

2. Description of Service

My Comuna is a community platform that connects residents in apartment buildings and residential communities. The App allows users to:

• Post updates and announcements to their building community
• Ask questions and get help from neighbors
• Share resources and recommendations
• Organize community events and activities
• Connect with neighbors who share similar interests

3. User Accounts and Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. If you are under 18, you represent that you have parental or guardian consent to use the App.

4. Acceptable Use Policy

My Comuna maintains a zero-tolerance policy for objectionable content and abusive users. You agree to use the App only for lawful purposes and in accordance with these Terms.

4.1 Prohibited Content

You may not post, upload, or share any content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or libelous
• Contains hate speech, discrimination, or promotes violence
• Is sexually explicit, pornographic, or contains nudity
• Infringes on intellectual property rights or privacy rights
• Contains spam, advertising, or commercial solicitations (except as permitted)
• Impersonates another person or entity
• Contains personal information of others without consent
• Promotes illegal activities or violates any applicable laws
• Is intended to deceive or mislead other users
• Contains malware, viruses, or other harmful code

4.2 Prohibited Behavior

You may not:

• Harass, bully, or intimidate other users
• Create multiple accounts to evade restrictions or bans
• Attempt to gain unauthorized access to the App or other users' accounts
• Use the App to stalk or monitor other users
• Engage in any form of cyberbullying or online harassment
• Use automated systems or bots to interact with the App
• Interfere with or disrupt the App's functionality
• Attempt to reverse engineer or modify the App

5. Content Moderation and Enforcement

My Comuna reserves the right to:

• Review, moderate, and remove any content that violates these Terms
• Suspend or terminate user accounts for violations
• Implement automated content filtering systems
• Report illegal activities to appropriate authorities
• Take any other action deemed necessary to maintain community safety within the app

5.1 Reporting Violations

Users can report objectionable content or abusive behavior through the App's reporting features. All reports are reviewed by our moderation team, and appropriate action will be taken.

5.2 Consequences of Violations

Violations of these Terms may result in:

• Content removal
• Temporary account suspension
• Permanent account termination
• Legal action if necessary

6. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Intellectual Property Rights

The App and its content, including but not limited to text, graphics, logos, and software, are owned by My Comuna and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of content you post, but you grant My Comuna a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content within the App.

8. Disclaimers and Limitations of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. MY COMUNA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MY COMUNA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.

9. Indemnification

You agree to indemnify and hold harmless My Comuna, its co-founders, officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

10. Termination

You may terminate your account at any time by deleting the App or contacting us. We may terminate or suspend your account immediately, without prior notice, for any violation of these Terms.

Upon termination, your right to use the App ceases immediately, and we may delete your account and content.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to Terms

My Comuna reserves the right to modify these Terms at any time. We will notify users of material changes through the App or by email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.
